- In accordance with the Excerpt – Minutes of the 15th Session of the Government of the Republic of North Macedonia, held on 10.03.2020, and the Excerpt of the Draft – Minutes of the 16th Session of the Government of the Republic of North Macedonia dated 11.03.2020, regarding undertaking enhanced measures and activities for prevention of spreading the disease COVID 19 (coronavirus), we inform You the following:
- As far as employees, parents/single parents who have under 10 years old child or who have children who are in forth grade at school are concerned and taking into consideration that those are children for whom home care is required, one parent will be freed of work and of working activities, so his/her absence during this period shall be registered as justified by the Employer in compliance with the adopted conclusions, measures and recommendations passed by the Government of the Republic of Macedonia on its 15th Session held on 10.03.2020 and as they are amended on 16th Session held on 11.03.2020. Also, they are required to submit to the Human Resources Department an evidence/confirmation about the ground of using the justified leave (confirmation issued by Day Care or paycheck for paid compensation about the stay in Day Care, a copy of the child`s passport proving the child`s age or a copy of the birth certificate, a copy proving that the child is a regular student issued by the education institutions, a copy of assessment certificates). Namely, those employees who will exercise justified leave based on the afore-mentioned grounds, shall submit to the Human Resources Department a Declaration declaring that under full moral, material and criminal responsibility, he/she will be available to the Employer, for the purpose of performing the working tasks from home, by using e-mail, also during the working hours and in case of urgency those employees shall be at their working positions in a period of two to three hours.
- Every parent/single parent who have 10 years old children who do not go to Day Care or are not included institutionally in the educational process are not freed of work and of working activities performance.
- Pregnant women and individuals who suffer chronic diseases are freed of work. Based on furnished evidence issued by the General Practitioner, the persons who suffer the following chronic conditions are freed of work:
- -Chronic respiratory diseases
- -Serious cardio vascular diseases
- -Type 1 Diabetes
- -Malignant diseases
- -Immunodeficiency disorders
- By following the conclusions, measures and recommendations passed by the Government of the Republic of Macedonia on its 15th Session at 10.03.2020 and at its 16th Session at 11.03.2020, during this period M-NAV GOJSC Skopje cancels all events, travels, gatherings, trainings, seminars, conferences and any meetings alike.
- Any employee returning from high-risk and medium-risk countries are required to self-isolate for 14 days (in accordance with the World Health Organization List regularly updated and published on the WHO web site, either on the following link: http://www.who.int/emergencies/diseases/novel-coronavirus-2019) or on: zdravstvo.gov.mk/wp-content/uploads/2020/03/Spisok-na-zemji 11.03.2020.pdf.
- Every employee should avoid travelling in countries of high-risk and of medium-risk (in accordance with the World Health Organization List regularly updated and published on the WHO web site, either on the following link: http://www.who.int/emergencies/diseases/novel-coronavirus-2019) or on: zdravstvo.gov.mk/wp-content/uploads/2020/03/Spisok-na-zemji 11.03.2020.pdf.
- Employees who do not follow the recommendations or who violate the recommendations, will be penalized in accordance with Article 205 which states: “A person, who, by violating regulations or orders by which the competent authority determines examinations, disinfection, separation of diseased persons or any other measures on suppressing or preventing contagious diseases in human beings, or by employing or keeping a person suffering from contagious disease and with committing sex activities causes contagious disease transmission, shall be either fined or shall be sentenced to up to three years prison. The punishment as stated in paragraph 1 also refers to any person who violates the provisions or orders as per paragraph 1 regarding the suppression or prevention of contagious diseases in animals, that can be transmitted to human beings, thus causing contagious disease transmission. If contagious incurable disease is transmitted as a consequence of any act as per paragraph 1, the performer (offender) shall be sentenced from one to ten years prison. Any attempt to act as per paragraph 1 regarding the transmission of incurable infectious diseases is subject to punishment. The person who will endanger the security of other person, by false threat regarding the transmission or by spreading false statements regarding the occurrence of incurable contagious disease shall be fined or shall be sentenced up to six months prison. If the acts as per paragraphs 1 and 2 are done by negligence, the person performing them shall be either fined or sentenced up to six months prison. In case when legal entity performs the act as per this Article, the legal entity shall be fined” and Article 206 according to which: “The person who during the epidemics of some contagious diseases does not follow the provisions or orders that cover measures for its suppression or prevention, shall be either fined or sentenced up to one year prison. If the act of this Article is done by legal entity, it shall be fined” of the Fine Criminal Code (“Official Gazette of the Republic of Macedonia”, no. 37/96, 80/99, 4/02, 43/03, 19/04, 81/05, 60/06, 73/06, 7/08, 139/08, 114/09, 51/11, 135/11, 185/11, 142/12, 166/12, 55/13, 82/13, 14/14,27/14, 28/14, 41/14, 115/14, 132/14, 160/14, 199/14, 196/15, 226/15, 97/17 and 248/18).
